Terms & Conditions for Public Sales by the Asset Management Unit
1. Eligibility to Participate:
This public sale is open to all members of the public who are 18 years of age or older. Foreign citizens may also participate. Individuals below the age of 18 are strictly prohibited from participating.
2. Offer Submission Process:
All interested individuals must submit their offer via email to the AMU at amo@finance.gov.sc. Along with the offer, participants must provide a copy of a relevant identification document, such as a national ID card, valid driver’s licence, or passport. Offers without valid identification will not be considered.
3. Sale Date and Duration:
The sale will run for the period stipulated in the advert relating to the particular asset or property that is to be sold.
Interested participants should refer to the advert for the exact sale end date.
A copy of the advert will be placed in different publications, and will also be available on the Ministry of Finance Website.
4. Viewing of the Asset:
Interested individuals may arrange a viewing of the asset by contacting the AMU via email at amo@finance.gov.sc. Viewings will be arranged at a mutually agreed time and location.
5. Sale Terms:
All items are sold on an “as is” basis. Buyers are responsible for conducting their own inspections of items. The AMU, the Ministry of Finance, National Planning and Trade, and any appointed agents make no warranties or guarantees regarding the condition of any items, assets, or property offered for sale. Once purchased, items, assets or property are non-refundable and non-returnable.
The AMU will consider all offers after the sale period stipulated in the advert has come to an end. Any decision on whether to accept an offer is at the sole and absolute discretion of the AMU and the AMU reserves the right to reject any offer, including the highest offer, without obligation to provide a reason.
6. Payment and Collection:
When the AMU accepts an offer, the successful buyer will be required to make payment via bank transfer within 48 hours from the AMU providing the sale confirmation. Payment details will be provided at the time of sale confirmation by the AMU.
To confirm payment, the funds must originate from the successful buyer’s bank account. Failure to make payment within the specified timeframe will render the sale null and void. The AMU may offer the item to the next highest bidder or include the item in any future sale or auction.
Upon confirmation of payment, successful buyers will need to send a copy of the bank transfer to the AMU. The AMU will, in turn, send a confirmation and receipt to the buyer once the funds have cleared in the Government account. The buyer will need to present this confirmation and receipt to proceed with collecting the item. Collection details will be agreed upon between the buyer and the AMU. Buyers must present valid identification at the time of collection. If the successful buyer is unable to collect the item personally, they may nominate another person in writing, who will need to present their own ID, a letter of nomination, and a copy of the buyer’s ID.
7. Force Majeure:
In the event of force majeure, such as natural disasters, accidents, or technical system outages, the AMU reserves the right to cancel the sale without liability. Participants will be informed should such circumstances arise.
8. Incorrect Information:
Interested individuals agree to provide accurate, current, and complete information as part of this sale process and to update such information to keep it accurate, current, and complete. Any changes should be notified to us immediately.
If any incorrect information is provided during the submission process or the sale, and it is discovered by the AMU, the AMU reserves the right to disqualify the participant from the current sale and any future sales.
9. Privacy Policy:
The privacy of all individuals who use our website and/or participate in AMU sales processes is important to us. Please refer to our Privacy Policy for further information about how we collect, process, use, store and share your personal information.
By submitting an offer as part of this sale process, interested individuals:
● confirm that they understand that we will collect, process, use, store, and share personal information in accordance with the Privacy Policy; and
● consent to the collection, processing, use, storage, and sharing of your personal information as described in the Privacy Policy.
